Document Can I just pay the prescription charge shown on my Penalty Charge Notice (PCN) and not the penalty charge?

No, the penalty charge is payable as you have claimed help with NHS charges incorrectly, even if it was claimed by mistake. This is a civil penalty; it is not a criminal matter and it does not imply that there was any fraudulent intent.

There is a duty of care when claiming help with NHS charges and it is expected that a patient will read the declaration before signing, and only sign it if it is true. It is the patients’ responsibility for this declaration.

The penalty charge is issued in accordance with The National Health Service (Penalty Charge) Regulations 1999 or The National Health Service (Penalty Charge) (Wales) Regulations 2001.
