Document I am a member of the 1995/2008 section and I am not subject to Protection, what will happen to the benefits I have accrued so far?

If you are not subject to Protection, any pension benefits that you accrued up to 31 March 2015 will be retained and calculated using your final pay at retirement providing that you do not have a break of more than five years.

If you have a break of more than five years, your benefits will be calculated in accordance with the rules of the 1995/2008 sections up to the point of when your five year break began.

You can still claim your accrued 95/08 benefits at the appropriate normal retirement age however you will need to retire from NHS employment by taking a 24 hour break and, if you are in the 1995 section only, you must not undertake NHS work for more than 16 hours per week in the following month.
